An individual going through a mediation process should consult with an experienced family law attorney. The mediator should be a neutral individual. Before you go into a mediation setting, you should have an understanding of your rights and a reasonable outcome. A family law attorney can consult with you outside of the mediation process and educate you, or alternatively the attorney can attend the mediation with you as part of the mediation process. Either way, mediation can provide you and your spouse with a more comfortable and nonadversarial setting for resolution of your issues, all of which can be addressed during a mediation session. If the mediation process is not an option, perhaps due to your spouse’s unwillingness to pursue a reasonable outcome, litigation remains an option.
